Once planning permission has been granted, agreement from the adjoining owners that abut a development is required.

Under the requirements of the Party Wall etc. Act 1996, notice should be given to ensure that the adjoining owners are given sufficient time to review the proposed works. This before they consent or dispute the proposals.

Depending on the type of works proposed, the expiration of 14 days, 1 month or 2 months results in the adjoining owner being automatically in dispute.

At this stage a 2nd surveyor may be appointed to liaise with the individual proposing to carry out the works. A 3rd surveyor is also required in order to form an award.
