Units with an outdoor space must ensure 50 per cent is open should they permit smoking in that space. 

Since the introduction of the Health Act 2006 and the Smoke free legislation of 2007, local authorities have been ensuring that there is no internal smoking in commercial premises. This has meant an influx of outdoor smoking areas, sometimes without council permission.
